Terms & Conditions of Sales
1. Purpose
These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in the context of booking, online or directly, tourist stays offered by the guest house Le Jardin des Cèdres. They govern all stages of the booking and the stay.
Confirmation of the reservation constitutes unreserved acceptance of these General Terms and Conditions and the specific terms of sale of the reserved rate.
2. Reservation
The reservation becomes effective upon receipt of a deposit of 25% of the total amount of the stay.
It is nominative and cannot be transferred to a third party without the prior agreement of the institution.
3. Length of stay
The contract is for a fixed term. The client cannot claim a right to remain on the premises after the scheduled departure date.
4. Prices and taxes
Prices are shown in euros, including all taxes.
For clarity and to avoid any additional charges during your stay, the tourist tax is included in the displayed price.
However, it will appear clearly on the invoice, in accordance with reporting requirements.
The tourist tax is a local tax that the guest must pay to the owner, who then remits it to the tax authorities. For your information, the amount is €0.92 per night per adult (adult).
Any changes to applicable laws (VAT, local taxes, etc.) will be applied automatically. The establishment is not currently subject to VAT.
5. Payment
The deposit is paid at the time of booking. The balance of the stay, including any additional services booked during the stay, is payable on arrival or departure.
The accepted payment methods are: Credit card (Stripe, Visa, Mastercard, American Express), Paypal, cheque, bank transfer, cash and holiday vouchers (paper or connected).
6. Cancellation or modification
Any cancellation must be notified by email or post.
More than 30 days before the stay: full refund of the deposit.
Between 30 and 8 days: 30% deposit retained.
Between 7 and 2 days: 50% of the booking will be charged.
Less than 2 days or no-show: balance due
Shortened stay: no refund.
In the event of cancellation by the owner, all sums paid will be fully refunded.
7. Arrival and departure
Accommodation is available from 5pm and must be vacated before 11am.
No early arrivals will be accepted without prior agreement.
In case of late arrival (after 9pm) or delayed arrival, the client must notify the owner. In the event that late arrival prevents the customer from enjoying the meal and the meal has been ordered, the meal remains due to the owner if costs and preparations have already been incurred.
Late departures are not permitted.
8. Respect for the premises
The client agrees to use the premises peacefully and to respect the intended purpose of the accommodations.
The establishment is strictly non-smoking.
While pets are welcome, they are not allowed. If the client violates this rule, the owner may refuse the stay. In this case, no refund will be given.
The client agrees to return the accommodation in perfect condition at the end of the stay, and to declare and financially assume any damage for which they may be responsible.
Areas not shown to the client upon arrival, or private areas, are not left at the free disposal of guests.
9. Capacity
The maximum capacity of the establishment is 15 people, including all accommodations.
Only guests staying at Jardin des Cèdres are permitted to enter the premises, use the facilities, and enjoy the swimming pool.
The reservation is made for a specific number of people. The owner may refuse entry to additional people who would join the reservation without prior agreement. This refusal cannot under any circumstances be considered a modification or breach of contract initiated by the owner, so if more guests arrive than were refused, no refund will be given.
10. Liability and insurance
The client is required to have holiday insurance covering damages for which they may be liable.
The establishment declines all responsibility in case of theft, loss or damage to personal belongings.
Forgotten items can be returned upon request and at the customer's expense.
11. Force majeure
Neither party shall be held liable in the event of an unforeseeable and insurmountable event preventing the execution of the contract (natural disaster, pandemic, etc.).
12. Personal Data
The information collected during the booking process is necessary for its management. It may be transmitted to Elloha and Stripe for secure payment processing. In accordance with the GDPR, the customer has the right to access, rectify, and delete their data by contacting lejardindescedres@yahoo.com.
13. Disputes
These Terms and Conditions are governed by French law. In the event of a dispute, and after attempting to resolve the matter amicably, the customer may contact the relevant tourism and travel mediator. The establishment's consumer mediator is CM2C.
